By using the EchoWI website or services, you agree to the following terms:

1. Services Provided

EchoWI offers a SaaS platform for Generative Engine Optimization (GEO). We define strategies to improve brand visibility in AI responses. We reserve the right to modify or discontinue services at any time.

2. Billing, Payment, and Enterprise Contracts

A. Order of Precedence
If you have signed a separate Master Services Agreement (MSA) or specific Quote/Contract with EchoWI, the terms of that signed agreement shall take precedence over these Terms of Service in the event of any conflict.

B. Payment Methods

• Credit Card (Self-Service): For plans subscribed directly via the website, fees are billed in advance (monthly or annually) using our payment processor (Stripe). Subscriptions renew automatically unless cancelled via the platform settings.
• Invoicing (Enterprise): For plans paid via invoice, payment is due within 15 days (Net 15) from the invoice date, unless stated otherwise in your contract. Payment must be made via bank transfer.

C. Late Payments & Cancellation
Failure to pay invoices on time may result in the temporary suspension of access to the platform. We reserve the right to charge statutory interest on overdue amounts for B2B transactions.

D. No Refunds
EchoWI is a B2B service. Payments are non-refundable, and we do not provide credits for partially used subscription periods, regardless of the payment method used.

3. Digital Content & Consumer Rights Waiver

Business Use: EchoWI is intended for professional and business use. By subscribing, you represent that you are acting for purposes relating to your trade, business, craft, or profession (B2B).

Withdrawal Waiver: In the event that you are deemed a consumer under applicable law (e.g., a freelancer), you explicitly request immediate access to the EchoWI platform upon payment. You acknowledge and agree that by gaining this immediate access, you lose your right of withdrawal (the 14-day cooling-off period) regarding this digital content/service.

4. Nature of AI Services (Disclaimer)

• No Guarantee of Results: Given the evolving nature of Large Language Models (LLMs) like ChatGPT, Gemini, or Perplexity, EchoWI does not guarantee specific rankings, visibility percentages, or commercial outcomes. Our data serves as an optimization tool, not a guarantee.
• Third-Party Dependencies: Our service relies on third-party APIs and infrastructure. EchoWI is not responsible for interruptions, latency, or changes in third-party AI models that are outside our control.

5. Intellectual Property & Marketing

Ownership: All rights in the Service (software, algorithms, data) remain the exclusive property of EchoWI. You receive a limited license to use the platform.

Marketing Reference: Unless you explicitly request otherwise in writing, you agree that EchoWI may identify your company as a customer and use your name/logo in marketing materials and on our website.

6. Acceptable Use

You agree not to violate laws, reverse engineer the software, or interfere with the security of the platform.

7. Limitation of Liability

To the maximum extent permitted by law, EchoWI shall not be liable for indirect damages, lost profits, or data loss. For paid services, our total liability is limited to the amount paid by you in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Madrid.
